Recent Revisions to the DC/CV 82MH
Failure to Pay Park Owner's Complaint for Repossession of Rented Property

The DC/CV 82MH form has been revised to:

  • reflect the ruling in McDaniel v. Baranowski, decided on May 4, 2011. The Court of Appeals of Maryland held that a landlord who had failed to obtain a rental license pursuant to provisions of the Anne Arundel County Code was not permitted to initiate suits for possession of nonpayment of rent summary ejectment proceedings for residential tenant’s failure to pay rent under Md. Code, Real Property Article, § 8-401. The District Court Civil Committee has recently determined that the ruling also applies to Park Owners.

    The new language is inserted as #2 on the DC/CV 82MH (Rev. 7/20/11) as shown below:

    #2 Is the Park Owner required by law to be licensed/registered in order to operate this premises as a rental property? ___Yes ___No. If so, is the Park Owner currently licensed/registered ___Yes___ No. License/Registration number if applicable:_____________________.

The 7/20/2011 version of the DC/CV 82MH will also incorporate the following revisions from the 7/2011 version which was never printed.

  • additional fields for the signer's facsimile number and e-mail address per Rule 1-311, see the 168th Rules Order
    (effective July 1, 2011)

  • in section #2, the insertion of the word registered or registration after licensed or license per the Civil Judges Committee request.
The revised Failure to Pay Park Owner's Complaint. DC/CV 82MH is available online today through the link in this directive and in our online Forms Index. The printed forms will be ordered from a vendor; however, it will take approximately 3 - 4 weeks before the new version is available at our warehouse. Please wait until mid August before ordering the new version.

All filers MUST begin using the new 7/20/2011 version by September 21, 2011.
